FROSTBURG: TAKE 5 > RULES & REGULATIONS
OFFICIAL CONTEST RULES printable version
1. ELIGIBILITY. No purchase necessary to enter or win. A purchase will not increase your chance of winning. Contest is open to part-time or full-time students and graduates of Frostburg State University. By submitting an entry, participant agrees to be bound by these Official Rules. All applicable federal, state, and local laws and regulations apply. Contest is void where prohibited.
2. HOW TO ENTER : You may enter up to 3 submissions. To enter the Contest, submit your video by March 7, 2008, at 11:00 p.m. Eastern Time either by posting you clip online through the Frostburg: Take 5 Group, through delivery or mail at the following address: Becca Ramspott, Frostburg: Take 5, Division of Communications and Media Relations, Hitchins Building, Frostburg State University, 101 Braddock Road, Frostburg, MD 21532-2303. Please include the following information with your entry: a) your first and last name; b) your e-mail address; c) a telephone number where you may be reached. In addition,
- Your video must be five (5) minutes or less in length.
- Your video must be submitted in QuickTime Movie format on DVD to the stated contest mailing address.
- Your video must relate to the stated Contest subject matter.
- Your video must not contain harmful, obscene, defamatory, abusive, harassing, threatening or other objectionable material or content, as determined by Sponsor in its sole discretion.
3. JUDGING. All participants who meet the eligibility requirements set forth in Section 1 above are eligible to participate in the Contest. The Contest is one of content and appeal where submitted videos meeting the judges' approval will be determined to be winners. Each video will be ranked using the following criteria: a) composition, b) relevancy to topic, c) uniqueness. Entry must not have been entered in any other competition or violate the rights of other parties and may not include any intellectual property owned by a third party such as material protected under copyright or trademark law. Winners will be required to provide a release from any person pictured in the video authorizing the use of the video and images contained therein as outlined herein prior to awarding of prize. Based on the criteria above Sponsor will judge all eligible entries and select one (1) Grand Prize winner and 4 prize winners (Second Place, Third Place, Fourth Place, Fifth Place. Sponsor's decisions are final. The Grand Prize Winner will be announced at a special screening Oct. 24 at the Frostburg Palace Theatre, 31 East Main Street, Frostburg, MD, 21532 . Each Entrant that is judged to be a winner may be afforded the opportunity to have their video placed on the Frostburg State University Web site.
4. PRIZE REDEMPTION . Sponsor will notify Winner(s) via the address provided by Winner during the registration process; the winning entries will then be screened during the special screening at Frostburg Palace Theatre. Awarding of prizes will be conducted by Sponsor, whose decisions are final on all matters relating to the Contest. Winners will be required to sign and return by mail within 14 days of receipt the Affidavit of Eligibility and Release and substitute W-9 form (including social security number). If Winner fails to return these forms within the time required, the prize will be forfeited and awarded to an alternate Winner. Any prize notification or prize returned as undeliverable will be forfeited. No prize substitution or cash redemption allowed by winners. Prizes are not transferable. Winners will be responsible for any and all taxes on the awarding of a Prize.
5. PUBLICITY. Except where prohibited, participation in the Contest constitutes Winner's consent to Sponsor's use of Winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Sponsor shall have all rights to copy, edit, broadcast, publish and use, in whole or in part, any entry, copyrighted or copyrightable materials, in any and all media now known or hereinafter developed without territorial or time or use restrictions and without further compensation.
6. GENERAL CONDITIONS. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
7. RELEASE. By receipt of any prize, Winner agrees to release and hold harmless Sponsor, the University System of Maryland, the State of Maryland and each one's respective employees, agents, volunteers, affiliates, and prize suppliers, (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize or use of the video in any manner.
8. LIMITATIONS OF LIABILITY. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize in any manner. No more than the stated number of prizes will be awarded.
9. DISPUTES. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State and Federal Courts of Maryland; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules.
10. CONTEST RESULTS. Winner's first name, last initial and home city/state will be available to the public subject to winner notification and eligibility confirmation.
11. DISCLAIMER. Sponsor, the University System of Maryland, the State of Maryland and their respective employees, agents and volunteers will not be responsible for, a) any late, lost, misrouted, or damaged entries; b) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; c) any printing or typographical errors in any materials associated with the Contest; or d) any appropriate cancellation of the Contest as determined by the Sponsor in its sole discretion. Videos that do not conform to the spirit of the Contest and Frostburg State University policies and procedures will be automatically disqualified. This includes, but is not limited to videos depicting: bodily harm to humans or animals; damage of property, either private or public, including theft; trespassing; and violations of law. Frostburg State University reserves the right to reject any submissions that it determines, in its sole discretion, to be unacceptable and is under no obligation to consider any such videos for participation in the Contest.
12. GENERAL RELEASE. By entering the Contest, you release Frostburg State University, the University System of Maryland and the State of Maryland and any of their respective directors, officers, employees, agents and volunteers (collectively the 'Released Parties') from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
13. COPYRIGHT NOTICE. By entering the Contest, entrants represent and warrant that they have not violated federal or state copyright laws and regulations. Any videos determined by Frostburg State University to contain violations of copyright laws will be disqualified. Videos and all accompanying materials submitted become the intellectual property of Frostburg State University, with all rights reserved. 14. MISCELLANEOUS. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the United States and the State of Maryland, and the official policies and procedures of Frostburg State University. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
